India should keep Kashmir in mind before disappointing USA

Dear Sir or Madam

Sub:- India playing militarily dangerous game with USA on Ukraine / Crimea

--- While underlining India's position on "unity and territorial
integrity" of countries, government of India made it clear that - "[It
will not support any 'unilateral measures' against Russian government.
India has never supported unilateral sanctions against any country
e.g. Iraq or Iran etc, therefore, on the issue of Ukraine India will
also not support any unilateral measures by a country or a group of
countries against Russia]".

This stand of India is against its self-interest and has emerged out
of ignorance and lack of global responsibility. It is imperative that
India should work for and demand, as explained and given below, the
solution of Ukraine / Crimea problem as per rule of law (not merely
national but international too through UN), otherwise India may face
insurmountable military problems in near future:-

(1)- India should not think that USA & its Allies are so naive that
they will not notice the anomaly in India's excuse by giving examples
of Iran, Iraq etc. India should know that unlike other cases, Russia
is a veto wielding country hence there can be no sanctions against
Russia through UN.

(2)- Notwithstanding public postures of government, politicians,
political commentators of USA:-

(i)- Though USA is trying to rope-in Europe (EU and others) in taking
stand against Russia but USA knows that unlike Georgia, Syria etc
(which were / are the moral responsibility of USA), the Ukraine /
Crimea is the legal responsibility of USA as per  'Budapest Memorandum
on Security Assurance' (BMSA) of 1994 under which Ukraine gave up its
nuclear weapons. If territorial integrity of nuke denied Ukraine is
not protected by USA then not only Iran, but many other countries will
say that nukes are the only guarantee of proper defense and this will
lead to extremely dangerous nuclear race at global level. Hence, USA
will be deeply humiliated and offended, with consequences, if USA does
not get a face-saver on Ukraine.

(ii)- India should be under no delusion. USA is deeply prejudiced
(culturally, politically, economically) in favor of Europe for the
simple reason (rather un-addressed weakness) that the majority of USA,
the powerful White Americans originated from Europe (therefore despite
UN, the US still maintains NATO). Hence without saying so (unlike
President 43 Bush) openly, not only the present administration of Prez
Obama but even practically entire USA thinks that on Ukraine / Crimean
issue 'Either you are with us or against us'.

(iii)- USA also knows that merely economic sanctions by USA & Western
Allies (how so ever stringent it may be) will not be enough to
constrain Russia to see reason on Ukraine. Therefore (if not through
economic sanctions), unless other globally important countries also
throw their political weight behind demand of observance of
international law by Russia about Ukraine / Crimea affair, nothing
worthwhile would be achieved by USA & Allies.

(iv)- This is precisely here that USA will watch 1.2 Billion
democratic India's role closely. Therefore India, before ignoring US
solicitations on Ukraine, should keep in mind the military problems
which USA & Allies can easily create for India in Kashmir, N-E etc.
Just to give only one example. Has Hindu majority India asked Russia
whether Russia will support Muslims of Kashmir valley if they decide
(through a referendum) to go to Muslim Pakistan or to become
independent ?

(3)-  There are any numbers of countries where ethnic or religious or
linguistic minorities are there even with grievances, also in and
around India (like Kashmir valley, part of North - East in India,
Baluchistan, North - Western regions in Pakistan, Tamilian area in Sri
Lanka, Tibet in China etc). There is no problem in allowing such
regions to defect to neighboring countries or to become independent.
But, it should be done under global policy of UN through proper
discussion at UN. The way Crimea is being assimilated in Russia, it
would open unmanageable Pandora box at international level.

(4)-  But, India should not betray Russia at this crucial juncture.
Not only because Russia is the oldest, trusted and tested friend (from
the days of Russia's stand on Kashmir in India's favor, Bangladesh war
1971 etc) but Russia has a case on Ukraine as per international law
(and not merely because most of Crimeans speak Russian language). USA
(the leader of free world having UN  head office on its soil hence
responsible for protecting global political order by also not
interfering in internal matters especially of democratic countries)
and US Allies are not without blame on Ukraine:-

(i)- In addition to various statement from US Government which were
blatant interference in internal affairs of democratic Ukraine, In
December, 2013 (by taking a fig leaf of peaceful and democratic
resolution to the current crisis), the US Senate passed a resolution
S. Res. 319 that the Senate urges leaders in the United States and the
European Union to continue working together actively to support a
peaceful and democratic resolution to the current crisis that moves
Ukraine  TOWARDS A FUTURE IN THE EURO-ATLANTIC COMMUNITY.


(ii)- Many Americans and also no less a person than US Congressman
Dana Rohrabacher (Chairman House sub-committee of Foreign Affairs on
Europe, Eurasia and Emerging Threats) have been warning USA & its
Allies that they should not interfere in internal matters of Ukraine
(whether it wants to do business with EU or with Russia) especially
when there is elected government in Ukraine.

(iii )- As far killing of people by snipers during protests in
Ukraine, Russia asserts that according to a leaked telephone
conversation on Feb, 26 between Estonian Foreign Minister Urmas Paet
and European Union Commissionaire Catherine Ashton, the snipers who
shot at protesters and police in Kiev, were allegedly hired by
Ukrainian opposition leaders.

(iv)- Otherwise also protesters were using brute force and arson
during protests and even after February, 21 Agreement (Between Ukraine
government and opposition leaders which was under-written by Germany,
France and Poland by signatures and by Russia by consent). This
constrained President Yanukovych, also to leave the country. Unless
President Yanukovych is impeached through due process of law under
Article 111 of the Constitution of Ukraine (where Constitutional /
Supreme Court of Ukraine should be involved in impeachment
proceedings), the credibility of USA and its Allies will always remain
under cloud, on the count of blatant interference by them in internal
matters of Ukraine and use of brute force by protesters.

(5)- For resolving such controversial global issues, USA will
immensely support, if India pushes for  new global political order of
participatory UN with voting rights to all in place of veto rights to
some (preferably through existing UN or through parallel global
organization, if necessary), because:-

(i)- USA knows that no society (national or international) can
properly function without mechanism of sanctioned physical coercion in
the service of Law. Earlier USA was providing this source of
sanctioned physical coercion through American boots on ground. But,
nowadays USA has lost appetite for leading military actions in other
countries. Therefore, an alternate source of military force with UN is
required.

(ii)- In this age of globalization, without effective global political
order the economic activities at global level are impossible.
Therefore, USA, with largest economy of the world and Dollar as
de-facto global currency needs new global political order more than
any other country.

(iii)- Though, USA has forgotten the advice of one of its founding
fathers Thomas Paine who said in his pamphlet 'Common Sense' (which
greatly inspired US revolution in 1770s) that for enlightened people a
person (king of England) should not rule, hence 'Rule of Law' through
US war of independence. Ironically, USA itself presently has become
that King in existing global political order of UN. Nevertheless, such
seeds never die. If India persuades USA properly then USA will take no
time even in becoming the crusader for said new global political order
based on 'Rule of Law' (International).

(6)- Therefore in order to solve the Ukraine / Crimean and such other
crises, India should behave responsibly and should work for and demand
that (in addition to incorporation of Federalism in the Constitution
of Ukraine, where Ukrainian each State Government should be free to
decide whether it wants to contract with EU or with Russia or with any
other country on economic matters):-

(i)- Failed veto wielding UN (which is facing problems practically
every where including in Syria due to veto) should be replaced with
non-veto participatory UN where in amended UNSC all UN members should
have voting rights as per formula based on contribution to UN of men
(including martial for Peace Keeping Force & civilians as election
conducting personnel to assist United Nation Election Commission,
UNEC), material (machines, equipment, armaments, ammunition etc) and
money (mainly based on GDP of the member countries).

(ii)- International law should immediately be evolved at UN where
independence or merger of any part of UN member country will be
properly debated at UN and will be allowed, indiscriminately, to do so
only after UN approval.

(iii)- Nuclear dis-armament of all should be carried out by UN in a
time bound program.

(iv)- There should be elections in Ukraine (including Crimea), before
year 2014 end (time is the best healer, hence some time will be
required by Ukraine to calm down before elections). Under UN
observance, these elections should be held under
'Transitional-Government' (formed under UN observance) in which
persons in equal numbers from last regime and present regime should be
there.
